Alabama: Irondale Proposes Public Vaping Ban with Fines Reaching $200
The Irondale City Council will consider an ordinance on Tuesday, Oct. 20, that expands municipal smoking restrictions to include electronic cigarettes, vape pens, and related vapor devices across enclosed public spaces, city parks, and recreational facilities.
Under proposed Ordinance 2026-29, individuals caught smoking or vaping in restricted areas face fines ranging from $50 to $200 per offense. Both Irondale police officers and authorized code enforcement officials will handle enforcement.
Addressing Secondhand Vapor in Public Areas
City officials noted that current local regulations do not specifically address modern electronic vaporizers. The update aims to reduce public exposure to secondhand smoke and vapor aerosols, particularly in spaces frequented by children and families. The rule defines electronic devices broadly, covering e-cigarettes, e-cigars, vape pens, e-hookahs, and heated tobacco units, even if the vapor contains zero nicotine.
| Prohibited Locations | Exempt / Permitted Locations |
|---|---|
| Enclosed public spaces (restaurants, malls, libraries) | Private residences and personal vehicles |
| City-owned parks, running tracks, and skate parks | Standalone bars and lounges not attached to diners |
| Playgrounds, athletic fields, bleachers, and courts | Retail vape and tobacco shops |
| Public transport facilities and municipal vehicles | Designated outdoor zones at least 25 feet from doors |
Business Requirements and Council Vote
The proposal mandates that commercial establishments post visible notices alerting patrons that smoking and vaping are prohibited on the premises. Business owners who fail to make reasonable efforts to inform visitors could face administrative penalties.
The Irondale City Council is scheduled to take up the ordinance at 6 p.m. on Tuesday at City Hall. If passed, the regulations will take effect after official adoption and public notice.
