Texas Implements Ban on THC Vape Pen Sales on Sept 1st
A new Texas law, Senate Bill 2024, has taken effect as of Monday, September 1st, making it illegal to sell or market vape pens containing cannabinoids like THC. This move has sent shockwaves through the state’s burgeoning hemp industry, with retailers forced to pull one of their most popular product categories from the shelves.
The new law classifies the sale or marketing of vapes containing cannabinoids as a Class A Misdemeanor, which carries potential penalties of up to one year in jail and a $4,000 fine. While the law makes selling these products illegal, it does not criminalize the mere possession of a THC vape pen by a consumer.
Supporters of the ban argue it will help keep concealable THC vapes out of the hands of teenagers. However, opponents and business owners are concerned it will have unintended negative consequences. Tommy Saldivar, a cannabis consultant at Gruene Botanicals in Austin, said many were “caught off guard” by the law. His colleague, Sebastian Sandoval, noted that THC vapes accounted for 50-60% of their inventory.
“Whenever you completely outright ban something, people are still going to look for those products. You’re moving people to a black-market world now rather than giving them the opportunity to come into a shop like this where we can talk to them about the brand and what’s inside that product,” Sandoval said.
Retailers also argue that these products are vital for customers, including veterans and cancer survivors like Saldivar, who use them for chronic pain, PTSD, and other ailments. The industry’s future remains uncertain, with another bill (Senate Bill 6) that seeks to ban all THC products still under consideration. Many business owners, like Sandoval, believe that “regulation rather than an all-out ban” would be a more effective way to manage the industry and protect consumers.
