Malaysia: Health Ministry Finalizing Report on Vape Ban

The Malaysian Ministry of Health is finalizing a detailed report on a proposed ban of e-cigarettes and vapes, which will be presented to the Cabinet, Health Minister Datuk Seri Dr. Dzulkefly Ahmad has confirmed. He stated that the government’s direction is clearly towards a ban, emphasizing, “It is no longer a question of if we ban, but when we ban.”

Speaking in the Dewan Rakyat, Dzulkefly said an expert committee is considering various factors, including the use of prohibited substances like drugs in vape liquids and broader health risks such as EVALI (e-cigarette or vaping-associated lung injury). He acknowledged that an immediate total ban is complex because the government has already gazetted the Control of Smoking Products for Public Health Act 2024 (Act 852), which regulates the industry. An abrupt prohibition could expose the government to legal challenges from industry players with legitimate expectations under the current law.

While the report is being finalized, the ministry will also bring the issue to the regional level, proposing that vape control be included on the agenda of the ASEAN Health Ministers Meeting next year.
