Massachusetts: Marlborough Considers Lifetime Ban on Nicotine Sales

The Marlborough Board of Health will host a public hearing on October 6 to evaluate a policy that would permanently ban nicotine and tobacco sales to anyone born on or after January 1, 2010. The measure aims to establish a nicotine-free generation within the Massachusetts city.

Expanding Beyond Current Age Limits

Under current Massachusetts law, buyers must be at least 21 years old to purchase nicotine and tobacco products. The new proposal would prevent the target generation from ever buying these goods, even after they begin turning 21 in 2031.

The restriction covers combustible cigarettes, cigars, electronic nicotine delivery systems, vaping devices, smokeless tobacco, and synthetic nicotine pouches.

City Council Support and Legal Precedent

While the Board of Health has not yet drafted final regulations, the policy holds strong local support. On June 8, the Marlborough City Council voted 10-0 to endorse a resolution backing the January 1, 2010 cutoff date.

Municipal birthdate-based restrictions hold established legal standing in Massachusetts. In the 2024 case Six Brothers Inc. v. Town of Brookline, the Massachusetts Supreme Judicial Court ruled that state law permits municipalities to enact local tobacco bans. The court confirmed that birthdate-based limits do not violate equal protection guarantees.

Community Feedback at City Hall

The public hearing is scheduled for 6 p.m. on Tuesday, October 6, in Memorial Hall on the third floor of Marlborough City Hall (140 Main St.). City officials emphasized that the session is intended to gauge community sentiment before deciding whether to advance formal rulemaking.
