UK Retailers Face 100-Day Countdown for Phased Tobacco and Vape Bans

The Local Government Association (LGA) has warned retail stores, online platforms, and business groups across the UK to prepare for strict new sales restrictions. The alert marks the 100-day countdown until sales of combustible tobacco are permanently outlawed for anyone born on or after January 1, 2009.

Before the generational tobacco ban takes effect, retailers face an earlier compliance deadline on October 29, 2026. On this date, selling any vaping device, zero-nicotine vape, or nicotine pouch to anyone under 18 becomes a criminal offence subject to fixed penalty notices.

Phased Enforcement Timetable

The new framework rolls out in two distinct stages under the Tobacco and Vapes Act 2026:

Phase 1 (October 29, 2026): Minimum age limits extend to non-nicotine vapes and pouches. Vending machine sales are prohibited except in adult mental health inpatient facilities, and volume-discount promotions are restricted.
Phase 2 (January 1, 2027): Retailers cannot sell tobacco products, herbal smoking items, or rolling papers to individuals born on or after January 1, 2009. Proxy purchasing by adults on behalf of this cohort also becomes illegal.

Retailer Compliance and Till Protocols

Local authorities emphasize that stores must change how checkout staff check customer identification. Rather than judging whether a buyer appears over 18 or 25, staff must check the customer’s exact date of birth against the 2009 cutoff date.

Cllr Dr. Wendy Taylor MBE, Chair of the LGA’s Health and Wellbeing Committee, stated:

“From January, the question at the till changes. Staff will be checking a date of birth against a fixed date, not making a judgement about whether someone looks old enough. That takes practice, and it takes a conversation with the people working your evening and weekend shifts.”

Stores selling tobacco must also display official point-of-sale signage stating: “It is illegal to sell tobacco products to anyone born on or after 1 January 2009.” Trading Standards teams are urging business owners to train seasonal staff and review digital age-verification filters before the October deadline.
