National City (San Diego, California) Approves Tobacco & Vape Licensing Program
The National City Council has unanimously approved a comprehensive tobacco retail licensing ordinance aimed at reducing youth access to tobacco and vaping products. The decision follows over a year of debate, prompted by what city officials described as a “serious problem with vaping among young people” in local schools.
Under the new ordinance, all tobacco retailers must obtain an annual license at a cost of $700, with the total number of licenses capped at 54 citywide. To curb retailer density, new tobacco sellers will be prohibited from operating within 1,000 feet (305 meters) of youth-serving facilities, other tobacco retailers, or cannabis businesses. “We are aware that in our schools we have a serious problem with vaping among young people, and we see it frequently,” stated Councilmember José RodrÃguez.
The council made several amendments following the first reading, including modifying the penalty structure. The new system includes a warning for a first violation, a $1,000 fine for a second, a $5,000 fine plus a 30-day license suspension for a third, and license revocation for a fourth violation within a 36-month period. The ordinance also clarifies that licenses are transferable between owners but not between locations, addressing business succession concerns.
Mayor Ron Morrison defended the city’s tailored approach, stating, “There is no one-size-fits-all solution.” The ordinance, which takes effect 30 days after approval, is National City’s first to include specific compliance monitoring provisions. The city plans to conduct annual inspections and biennial compliance checks using individuals aged 18 to 20 to ensure adherence to age-restriction laws.
