Florida Bill Proposes Statewide Public Smoking & Vaping Ban
A new bill in Florida, House Bill 389, could significantly expand restrictions on where people can smoke and vape across the state. The proposed legislation aims to create a uniform, statewide ban on smoking and vaping tobacco or marijuana in numerous public areas, potentially overriding existing local rules.
If passed, HB 389 would prohibit smoking and vaping on streets, sidewalks, highways, public parks, and beaches. The ban would also extend to both indoor and outdoor common areas of schools, hospitals, government buildings, apartment complexes, offices, hotels, restaurants, transportation facilities, and retail shops. Unfiltered cigars would be exempt from the new rules, and exceptions would be allowed for designated areas like airport smoking rooms.
The bill has drawn mixed reactions. While many municipalities like Collier County and Naples already have local smoking restrictions, this statewide law would go further. Some residents express sympathy for smokers who are considerate, while others support the measure, arguing that a harmful habit like smoking should not be permitted in public spaces. Kaitlin Anders suggested smoking on the beach should be allowed as long as no trash is left behind, whereas Michael Pierce stated, “Nobody should be smoking, it’s not healthy.”
State lawmakers who sponsored the bill say it is intended to create consistent statewide rules and protect people from secondhand smoke. If passed, HB 389 would take effect on July 1, 2026.
