California Town Tiburon Enacts Total Tobacco & Nicotine Ban
The town council of Tiburon, California, has unanimously passed what is being called the strictest and most comprehensive tobacco and nicotine sales ban in the United States. The new ordinance enacts a complete prohibition on the sale of all tobacco and nicotine products within the southern Marin County town, including cigarettes, cigars, vapes, and other e-smoking devices. The ban also extends to the delivery of any tobacco goods.
Town Manager Greg Chanis noted that Tiburon was in a “unique position” to consider such stringent regulations as it currently has no existing retail tobacco sellers. The ordinance received strong support from local high school students of Marin County’s Youth Action Committee, who spoke in favor of the ban as a measure to protect their peers from the effects of smoking and vaping.
Unlike similar bans in other California cities like Manhattan Beach and Beverly Hills, which include exemptions for hotels or existing cigar lounges, Tiburon’s ban is more absolute. It also requires landlords to include anti-smoking clauses in all leases for multi-unit properties and allows citizens to bring civil action against repeat violators. Fines for violations range from $250 to $1,000, with illegal sales classified as misdemeanors. The ordinance, which takes effect in December, reinforces Marin County’s reputation as one of the healthiest in California.
