Buenos Aires Enacts Law 6964 to Regulate E-Cigarettes and Nicotine Pouches

The Government of the City of Buenos Aires has enacted Law No. 6964, establishing a regulatory framework for e-cigarettes, heated tobacco, and nicotine pouches. Sanctioned on June 18, 2026, and promulgated on July 16, the law treats these products as harmful to health and extends existing tobacco control rules to cover them.

Under the new rules, vaping is banned in all enclosed public and private spaces with public access. This restriction covers schools, hospitals, museums, cultural centers, and public transit systems.

The legislation targets youth appeal by banning all sales and distribution to minors under 18. Advertising, promotion, and sponsorship are prohibited, except for health information displayed inside authorized shops. Additionally, nicotine companies cannot sponsor sports, educational, or cultural events.

To monitor health impacts, the Ministry of Health will establish a registry for diseases linked to these products, including cardiovascular, respiratory, and mental health issues, alongside cases of E-cigarette or Vaping Use-Associated Lung Injury (EVALI). Public hospitals must report confirmed or suspected cases within seven days of diagnosis.

The law also addresses environmental concerns. It introduces recycling protocols for electronic and plastic waste generated by these devices, such as lithium batteries and cartridges, integrating them into the city’s waste collection system.

Fines collected from violations will fund prevention campaigns in high schools, annual public awareness drives, and environmental cleanup efforts. The executive branch has 180 days to draft the specific operational rules and name the enforcement authority.
