Buenos Aires Proposes Total Smoking and Vaping Ban in Public Parks
Argentine Deputy Ayelén Rasquetti has introduced a legislative bill to establish smoke-free public spaces across the Buenos Aires province. This regulatory push, aimed at modernizing Provincial Law No. 13,894, responds to growing public health concerns regarding secondhand exposure and environmental pollution in family-centric outdoor areas.
The proposed reform targets a wide range of inhalation devices. It prohibits the use of traditional tobacco products, e-cigarettes, electronic nicotine delivery systems (ENDS), vapes, and heated tobacco products in plazas, parks, playgrounds, green spaces, and bike lanes. Crucially, the ban also extends to the immediate entrances and outdoor grounds of educational and healthcare institutions.
According to Rasquetti, the initiative addresses critical gaps in Argentina’s national tobacco control law (No. 26.687), which does not explicitly regulate outdoor recreational spaces. Citing World Health Organization (WHO) guidelines, the bill emphasizes that there is no safe level of exposure to secondhand smoke, even in open-air environments where people gather in close proximity.
Beyond immediate health benefits, the bill highlights two major societal impacts:
- De-normalization of Smoking:Â Reducing the visibility of smoking in playgrounds prevents children from normalizing the habit and lowers early curiosity.
- Environmental Protection:Â Cigarette butts are the most frequent litter in urban plazas, leaching nicotine, heavy metals, and microplastics into the soil, while posing an ingestion hazard to toddlers.
The proposal draws on successful precedents from countries like Uruguay, Spain, Chile, Mexico, and the United States. If passed, the law will mandate clear warning signage in restricted areas and establish strict penalties for violators, with local municipalities leading enforcement efforts.
