EU Tobacco Tax Overhaul: Vapes and Cigarettes Face Hikes

The European Commission is moving forward with updates to the Tobacco Taxation Directive to curb nicotine consumption across the bloc. This initiative targets the rapid growth of vapes and heated tobacco products, aiming to reduce smoking rates to under 5% by 2040.

One in four Europeans continues to smoke or regularly use tobacco. This habit causes approximately 700,000 deaths annually within the European Union, making it a primary preventable cause of cancer and cardiovascular disease.

Professor Martin McKee, Strategic Advisor at the European Public Health Association, explained the fiscal reality of the situation: “The EU faces around 700,000 deaths each year linked to tobacco use. It remains one of the leading preventable causes of cancer and cardiovascular conditions. From a health standpoint, low taxes effectively subsidize consumption of a product that, when used as intended, causes fatal outcomes in up to half of long-term users.”

Smoking rates vary widely across the bloc. According to Eurostat data, Sweden records the lowest smoking prevalence at 8%, while Bulgaria reports the highest at 37%. Southern and Eastern European nations, including Croatia and Greece, maintain smoking rates above 35%. Conversely, Western and Northern European nations like the Netherlands (11%) and Denmark (14%) have reduced tobacco use.

This high prevalence places a heavy financial burden on public healthcare systems. Treating chronic cardiovascular and obstructive pulmonary illnesses caused by tobacco costs the EU approximately €25 billion annually in direct medical expenses.

Rising Popularity of Alternative Nicotine Products

While traditional cigarette consumption has declined, younger generations are shifting toward alternative nicotine delivery systems. These products include electronic cigarettes, heated tobacco devices like IQOS, and oral nicotine pouches.

Although health authorities view these alternatives as less harmful than combustible cigarettes, they are not without risk. Research has identified toxic chemicals such as formaldehyde, acetaldehyde, and acrolein in their vapor. Additionally, nicotine exposure during adolescence can disrupt brain development and lead to long-term addiction.

Data from the World Health Organization shows that 11.6% of European teenagers aged 13 to 15 regularly use these alternative products. Marketing strategies have heavily targeted this demographic.

Professor McKee noted: “Marketing strategies and product designs play significant roles. These often involve youth-attractive flavors, aggressive promotion on social media, lifestyle branding, claims of being modern, cleaner, or safer, and discreet designs that are easy to conceal.”

The Legislative Battle Over the Tobacco Taxation Directive

To address these market changes, the European Commission proposed updating the Tobacco Taxation Directive (TTD). The draft directive aims to raise prices by increasing minimum excise duties on traditional cigarettes by 139% and introducing EU-wide minimum taxes on vapes and nicotine pouches.

The proposal also integrates raw tobacco leaf into the EU’s electronic tracking system to curb cross-border tax evasion and black-market smuggling.

However, the legislative path has stalled. In June 2026, the European Parliament rejected its advisory report on the directive following disagreements over amendments. Because tax legislation falls under the EU’s consultation procedure, Parliament’s vote is non-binding, and the final decision rests with the Council of the European Union.

Patriots for Europe MEP Tomas Kubin, the rapporteur of the report, clarified the legislative roles: “Many believe the European Parliament controls excise tax rates. We do not. Our role is advisory and has no binding effect on the Council.”

To pass into law, the directive requires unanimous approval from all 27 EU member states in the Council.

Member States Enact National Bans

As EU-wide negotiations continue, individual countries are moving ahead with domestic restrictions to meet the goal of a “Tobacco-Free Generation” by 2040.

Belgium has become the first EU member state to ban the sale of disposable electronic cigarettes. France has also approved a ban on single-use vapes while expanding outdoor smoking bans to public parks, beaches, and school zones.

Meanwhile, the Netherlands has implemented a strict flavor ban, outlawing all e-liquid flavors except basic tobacco, and is drafting laws to raise the legal purchase age for nicotine products from 18 to 21.

Economic Pressure on the Tobacco Industry

If the revised directive is approved, major tobacco companies will face direct challenges to their business models. The European tobacco market generates approximately €130 billion in annual sales.

Companies like Philip Morris International and British American Tobacco will no longer be able to use alternative nicotine products as low-tax loopholes to offset declining cigarette sales. Enhanced tracking of raw tobacco will also increase administrative and operational costs for manufacturers.

Consequently, consumers across the EU can expect higher retail prices for both traditional tobacco and alternative nicotine products if the Council reaches a unanimous agreement.
