Florida Law Bans Vape Shops from Selling Nitrous Oxide Starting October 1

Florida Governor Ron DeSantis signed CS/SB 432 into law, barring licensed tobacco and nicotine retailers from possessing or selling nitrous oxide starting October 1, 2026. Known as Chapter 2026-148, the legislation directly targets smoke shops and vape stores across Miami-Dade, Broward, Orlando, Tampa, and Jacksonville to curb the recreational misuse of inhalants.

How “Meg’s Law” Alters Rules for Vape Retailers

A central component of the new statute, titled “Meg’s Law,” creates Section 569.216 of the Florida Statutes. Under this provision, any business holding a retail nicotine or tobacco permit—along with its clerks and agents—is barred from selling, delivering, or holding nitrous oxide with the intent to sell.

Failure to comply exposes vape store owners and staff to third-degree felony charges. The Department of Business and Professional Regulation (DBPR) will enforce administrative rules to ensure retail nicotine outlets do not distribute inhalants for intoxication.

Tougher Criminal Penalties for Controlled Substances

Beyond retail vape regulations, CS/SB 432 targets illicit xylazine, an animal tranquilizer often diverted into the illicit drug supply. The law establishes a first-degree felony charge for trafficking 28 grams or more of xylazine, carrying mandatory minimum sentences ranging from 3 to 25 years in prison and fines reaching $500,000.

Florida vape shop operators must audit their current inventory before the October 1 deadline to remove non-compliant inhalant products and avoid felony prosecution under state law.
