Illinois Secures $20 Million Settlement with Posh E-Cigarette Distributors

Illinois Attorney General Kwame Raoul has secured a $20 million settlement with the distributors of Posh e-cigarettes, resolving a January 2025 lawsuit. The state alleged the company violated the Youth Prevention Vaping Act by selling unauthorized flavored disposable vapes and marketing them directly to minors.

The state’s lawsuit targeted Posh’s use of youth-appealing flavors, such as “Gummy Bear Ice,” “Ice Cream Cone,” and “Jelly Berry.” Investigators found the company actively promoted these products on Instagram using imagery designed to attract young consumers.

Under the terms of the agreement, the distributors cannot sell, distribute, or advertise Posh products in Illinois unless they obtain a marketing authorization order from the U.S. Food and Drug Administration (FDA). Currently, the FDA requires this authorization for all new tobacco and e-cigarette products before they can be legally sold.

Additionally, the settlement imposes strict marketing bans. The defendants cannot use cartoons, social media influencers, or models under the age of 35 to promote their products. They must also implement age-verification tools on all social media accounts where their advertisements appear.

This action is part of a broader effort by Attorney General Raoul to curb youth nicotine addiction. In June, a bipartisan coalition of 25 attorneys general successfully pressured Shopify Inc. to ban vape sales on its platform. Raoul has also urged the FDA to maintain strict approval standards for flavored e-cigarettes and called on credit card processors to block transactions for illegal vape sales.

The $20 million recovered from the settlement will directly support Illinois’ ongoing enforcement campaigns against illicit vaping manufacturers and distributors.
