Malaysia Debates Vape Tax vs. Total Ban

A recent announcement under the 13th Malaysia Plan (13MP) to potentially expand pro-health taxes to include vape products has sparked confusion and concern among anti-smoking advocates. They are now demanding clarity from the government on whether its ultimate goal is to regulate and tax vapes or to implement a complete ban on their sale and use.

NV Subbarow, education officer for the Consumers Association of Penang (CAP), expressed his confusion, questioning the point of taxing a product his organization believes should be banned outright. “The Health Minister must immediately clarify the government’s position on banning vape and e-cigarettes,” he said, arguing that vaping leads to addiction and substance abuse issues that will cost the government millions to address. CAP supports a total ban and suggests imposing higher taxes on traditional cigarettes and alcohol instead.

This debate follows Health Minister Datuk Seri Dr. Dzulkefly Ahmad’s recent statement in Parliament that Putrajaya is considering a nationwide vape ban, a shift from his earlier stance favoring regulation. However, Prime Minister Datuk Seri Anwar Ibrahim’s subsequent announcement of potential pro-health taxes has created uncertainty.

In contrast, the Federation of Malaysian Consumers Associations (Fomca) views taxation as a pragmatic interim step. Fomca’s secretary-general, T. Saravanan, acknowledged that a complete ban requires time for legislation and enforcement. “By implementing the taxes now, the government is showing that it is moving in the right direction… while laying the groundwork for a full ban in the future,” he said. He believes higher prices act as a deterrent, especially for youth, and generate funds for awareness campaigns. Dr. Mohd Afiq Mohd Nor of Ikram Health Malaysia also supports a complete ban but understands the need for a phased approach, viewing taxation as a viable short-term measure while regulatory mechanisms are established.
