Mississippi Ban on Non-FDA Approved Vapes Takes Effect

A new law banning the sale of non-FDA approved vaping products went into effect across Mississippi on December 1st. Following the passage of House Bill 916, all vape shops and retailers were required to remove unauthorized products, primarily targeting disposable vapes and flavored juices, from their shelves. Retailers had been given a 60-day grace period since October to comply.

The legislation aims to curb the sale of unregulated products, which account for roughly 54% of vapes sold nationally. While some business owners, like Bill Wikstrom of Vaporized, have transitioned to products on the state registry, others have raised concerns about the impact. However, law enforcement officials emphasize the public safety risk, citing incidents of juveniles suffering severe reactions to potent or even homemade vapes containing harmful chemicals. Marion County Chief Deputy Jamie Singley noted recent arrests for underage sales and stressed the duty to ensure safety.

Retailers found violating the ban now face significant penalties, with fines ranging from $500 to $1,500 per unauthorized product, per day.
