Northern Ireland Launches Tobacco and Vapes Act as England Delays Retail Licensing to 2027

The Northern Ireland Department of Health has enacted the first provisions of the Tobacco and Vapes Act 2026, establishing immediate youth-protection measures ahead of England’s delayed regulatory rollout.

Under the Commencement No.1 Order, several restrictions take effect on October 29, 2026. These include banning the sale of non-nicotine vapes and nicotine products to minors under 18, outlawing proxy purchasing, extending vending machine bans, and prohibiting free distribution and discounting. Following this, the “smoke-free generation” policy will take effect on January 1, 2027, banning tobacco sales to anyone born on or after January 1, 2009.

This timeline contrasts with England, where ministers delayed consultations on the proposed retail licensing scheme for tobacco, vapes, and nicotine products until 2027. This decision postpones key operational rules and implementation dates for English retailers.

Northern Ireland plans to introduce advertising restrictions and expand its Tobacco Retailers Register to include vape merchants by mid-2027. Local enforcement bodies are advising retailers to prepare for the autumn restrictions.
