UK Tobacco and Vapes Act: The Crucial Next Phase of Regulation
In April 2026, nearly a thousand days after it was first announced, the landmark Tobacco and Vapes Act officially became law. Marking the most significant shift in British tobacco legislation in nearly two decades, the act introduces a generational sales ban alongside sweeping powers for secondary legislation.
However, passing the law is merely the starting line. According to Peter Nixon, Managing Director of PMI UK and Ireland, the upcoming government consultations will dictate whether these measures successfully transition from symbolic gestures into workable public health victories.
The UK still has 5.3 million adult smokers. Consequently, the new regulatory framework must balance two urgent priorities: preventing youth nicotine uptake and providing viable, smarter pathways for adult smokers to permanently quit cigarettes.
A central pillar of the upcoming consultations is the potential introduction of a comprehensive licensing regime for tobacco and nicotine retailers. Given that the UK has required alcohol licenses for centuries, experts argue it is absurd that tobacco and vapes can still be sold without similar oversight in 2026.
A credible, rigorously enforced licensing system would raise the barrier to entry, establish clear accountability, and provide Trading Standards with the teeth needed to penalize rogue merchants. Without controlling who sells these products, local high street enforcement remains nearly impossible.
This oversight is desperately needed to combat organized crime. Currently, the UK hosts Europe’s second-largest black market for tobacco, with one-in-three cigarettes consumed being illicit. This rampant illegal trade deprives the UK Treasury of approximately £4.5 billion in annual tax revenue – dwarfing the total budget allocated to Trading Standards.
To reclaim control, the proposed licensing scheme must cover all merchants, including online retailers. By funding enforcement through licensing fees, the government can consistently support Trading Standards, hold individuals accountable, and permanently remove irresponsible operators from the market.
