West Virginia Hikes E-Cigarette Tax to 50% Effective July 1, 2026
West Virginia aggressively shifts its fiscal policy on vaping effective July 1, 2026, implementing a wholesale excise tax of 50% on all e-cigarettes, liquids, and components. House Bill 4482 replaces the previous volume-based tax of $0.75 per milliliter, significantly altering the cost structure for retailers and consumers.
Tax & Penalty (Effective July 1, 2026)
- New Tax Rate: 50% of wholesale price (Devices, Liquids, Components).
- Old Tax Rate: $0.75 per milliliter.
- Late Reporting Fine: Increases from $25 to $500 per month.
Compliance is mandatory. Distributors and retailers must register with the Tax Commissioner and submit monthly reports and payments by the 15th of each month to avoid the steep new penalties.
