Vape Ban in Bulgaria: Discussions to Limit Prohibition to Single-Use Devices

In a shift from the initial intentions of a complete ban on vapes in Bulgaria, which was adopted at first reading in parliament, discussions are now focused on limiting the ban to single-use devices (disposable vape). The proposed amendments to the Tobacco Products Act were examined during a round table discussion in the National Assembly before being considered in the plenary hall.

Among the proposed changes is a ban on flavored vapes and an expansion of the powers of regulatory authorities. Prof. Kostadin Angelov, Chairman of the Parliamentary Health Committee, stated, “Our main goal is to achieve an effective ban on vapes in the country. At the same time, we understand that if we do it the way we have done it, it will probably require a long period for the notification of the law. In other words, for two or three years, we will not change anything in the country.“

Concerns Raised Over Potential Increase in Contraband Trade

Representatives from the European Vape Industry Association warned of the potential consequences of implementing the proposed bans. They explained, “If we ban single-use e-cigarettes now, the share of contraband will increase by at least two and a half to three times. If we ban flavors in e-cigarettes, we are looking at least five or six times.“

The round table discussion highlighted the need to carefully consider the implications of the proposed amendments to the Tobacco Products Act. While the goal is to effectively regulate vaping products in Bulgaria, stakeholders are concerned about the potential unintended consequences, such as a significant rise in the contraband trade.

Balancing Public Health and Market Stability

As the Bulgarian parliament continues to debate the proposed changes to the Tobacco Products Act, it is crucial to strike a balance between protecting public health and maintaining market stability. The shift in focus from a complete ban on vapes to a more targeted approach, focusing on single-use devices, demonstrates an effort to find a middle ground.

However, the concerns raised by industry representatives regarding the potential increase in contraband trade underscore the need for a comprehensive and well-considered approach to regulating vaping products. As the discussions progress, policymakers will need to carefully weigh the potential benefits and drawbacks of the proposed amendments to ensure that the final legislation effectively addresses public health concerns while minimizing unintended consequences.
