FDA Flavored Vape Approvals Clash With NJ State Ban

The U.S. Food and Drug Administration’s (FDA) authorization of two flavored Glas e-cigarettes has sparked policy debates and complicated enforcement in states like New Jersey. The decision highlights the growing conflict between federal approvals and state-level flavor bans.

Age-Gating Innovation Sparks Internal FDA Rift

The FDA authorized two non-menthol Glas e-cigarettes branded as “Gold” (mango-flavored) and “Sapphire” (blueberry-flavored). The authorization relied on a technological safeguard: the devices are age-gated, requiring users to pair the vape with a smartphone app that verifies their age before activation.

However, the approval bypassed internal scientific consensus. FDA staff scientists recommended against authorization, but FDA Commissioner Marty Makary overruled their decision. Makary resigned on May 12 amid reports of pressure from the White House administration regarding flavored vape policies.

The Rise of Unauthorized Disposable Vapes

While the FDA has authorized only 45 e-cigarette products out of 26 million applications, critics point out that the agency has failed to clear the market of illicit products. Unauthorized disposable vapes, primarily manufactured in Shenzhen, China, currently control 70% to 86% of U.S. sales.

Public health advocates worry that authorizing flavored products will reverse declines in youth nicotine use. Conversely, industry stakeholders argue that the illicit market exists because the FDA has failed to authorize enough legal alternatives to satisfy adult demand.

Federal Approvals Complicate New Jersey Enforcement

The Glas authorization directly collides with local laws in jurisdictions like New Jersey, which banned all flavored e-cigarettes in 2020. Local enforcement has faced difficulties due to the flood of illicit disposables using ambiguous flavor names like “Blue Razz Ice.”

With the federal government now authorizing specific flavored devices, state regulators and local retailers face a confusing legal landscape regarding which products can be legally sold and possessed within state borders.
