France’s Disposable Vape Ban Faces Challenges as Illicit Sales Continue
Six months after France implemented a ban on disposable e-cigarettes, these popular “puffs” remain widely accessible through non-compliant grocery stores, vape shops, and a thriving online black market. Despite the law, which took effect on February 25th, many retailers continue to sell the banned products, often openly, while new devices designed to circumvent the regulation are already taking their place.
The ban was enacted to address the products’ appeal to youth and their significant environmental impact. However, enforcement appears to be a major challenge. One night-shop grocer in the Paris region admitted, “It changes nothing. We sold them before, there’s just more risk now. We’ve had a few checks, but they aren’t very thorough.” A 17-year-old high school student, Lisa, confirmed she can still easily buy them, stating, “Even as a minor, I’ve never been asked for my ID.”
The illicit market has also flourished on social media platforms like Snapchat, where sellers offer home delivery. This ease of access is concerning, given that in 2022, one in five middle school students and 44% of high school students in France had already tried vaping.
Furthermore, the National Committee Against Smoking (CNCT) warns that manufacturers are circumventing the ban with new “rechargeable” products. These kits, which contain a rechargeable battery and a single, non-removable, pre-filled e-liquid cartridge, technically escape the “single-use” definition but function identically once the pod is inserted. Amélie Eschenbrenner of the CNCT calls this a “simple circumvention of the ban” and notes these new products often contain the highest legal nicotine concentration (20 mg/ml), equivalent to more than a pack of cigarettes a day. The CNCT is now calling for further measures, such as reducing the number of available flavors and implementing neutral packaging, to truly curb youth vaping.
