Spain’s Proposed Vape Ban Sparks EU-Wide Controversy Over Free Trade
A draft bill from Spain’s Ministry of Health, led by the far-left Sumar party, has ignited a significant dispute in Brussels. The proposal aims to impose sweeping restrictions, including a ban on all vape flavors except tobacco and a nicotine cap that would effectively outlaw oral nicotine pouches. However, the plan has stalled amid strong objections from seven EU member states and the European Commission itself.
Countries including Hungary, Italy, Romania, Sweden, Greece, Czechia, and Croatia argue that Spain’s proposed measures breach the EU’s fundamental principle of free movement of goods. They contend that products legally sold in one member state should generally be allowed in others. Italy delivered a strong rebuke, stating the Spanish legislation would create a “trade barrier in the internal market,” while Greece urged amendments to ensure compliance with both public health goals and free competition.
Critics, like Patrik Strömer of the Association of Swedish Snus Manufacturers, label the proposal “ideological posturing, not serious public health policy,” arguing it lacks scientific rigor and relies on “alarmist rhetoric.” Sandra Gallina, Director-General of the Commission’s DG SANTE, also warned that some restrictions are so poorly designed they could backfire and harm public health.
Despite the widespread pushback, Spain has reportedly indicated it will not revise the bill, a move that has raised eyebrows in Brussels. The European Commission can now request amendments or face the prospect of other member states challenging Madrid in court, setting the stage for a potential legal showdown over national health policy versus EU market freedoms.
