California: Mill Valley Bans All Retail Nicotine and Vape Sales
Mill Valley has become the second municipality in Marin County, California, to approve a complete retail ban on all nicotine products and electronic smoking devices without exemptions. The City Council passed the measure unanimously on its second reading, setting an enforcement date of February 1, 2027.
The policy replaces the municipality’s previous tobacco retailer licensing framework with a complete prohibition on both storefront and delivery sales. While the sale of commercial products will end, the measure does not criminalize adult possession or restrict FDA-authorized smoking cessation therapies.
Addressing High Youth Vaping Rates
Local officials introduced the ordinance to counter disproportionate nicotine use among area teenagers. Marin County Public Health data indicates that 17% of local 11th graders report vaping, well above the statewide average of 10%.
“This is a huge moment for not just Mill Valley, but also for Corte Madera that’s joined us in this action,” Mayor Max Perrey said. “Hopefully, other cities and the county will follow suit as well, so we can prioritize public health and prioritize our kids.”
Mill Valley’s vote follows a series of increasingly strict tobacco policies across the region. Neighboring Corte Madera approved an identical zero-exemption ordinance in September, while jurisdictions including Tiburon, Ross, Beverly Hills, and Manhattan Beach have enacted similar retail prohibitions.
Retail Transition and Industry Response
The February 2027 effective date provides a grace period for the five active tobacco retailers currently operating within Mill Valley municipal boundaries.
The California Fuels and Convenience Alliance opposed the measure during public comment, arguing that product bans fail to eliminate consumer demand and simply shift purchases to neighboring jurisdictions. Trade representative Bryan Lam requested a one-year sunset clause to evaluate the economic and behavioral impacts of the ban, but the council approved the measure as written without adopting the revision.
