Nebraska Cracks Down on Uncertified Vape and Kratom Products
The Nebraska Department of Revenue has issued an active compliance reminder to wholesalers and retailers across the state: only certified electronic nicotine delivery systems (ENDS) and certified kratom products are legal for sale. State enforcement of these mandatory certification rules officially began on January 1, 2026.
State Inspections Uncover Over 200 Retail Violations
During the first six months of active enforcement, state officials completed more than 1,080 inspections targeting vape distributors and retailers, alongside 115 kratom inspections. While the majority of licensed businesses complied with the directory rules, inspectors cited dozens of non-compliant stores.

License Revocation and Product Seizure Risks
Retailers and wholesalers carrying uncertified inventory face civil penalties. For vape businesses, selling unlisted products can result in the direct seizure of inventory and the suspension or permanent revocation of state tobacco licenses.
State officials encourage retailers to cross-reference their current stock with the official online directories of certified ENDS and kratom manufacturers. Businesses holding unauthorized products must return that inventory to their wholesalers immediately to avoid ongoing enforcement actions.
