Is It Illegal to Vape or Smoke While Driving in Virginia?

Vaping Guides, Laws and Regulations

In the Old Dominion State, where interstate highways and historic byways crisscross diverse landscapes from the Blue Ridge Mountains to the Chesapeake Bay, drivers often have questions about blending personal habits with road rules. A top query is: “Is it illegal to smoke a cigarette or vape while operating a vehicle?” This guide provides a deep dive into Virginia’s laws, drawing from the Code of Virginia, DMV guidelines, and recent legislative updates to clarify the rules for drivers.

No General Ban, But Critical Exceptions Apply

As of 2025, there is no statewide statute that explicitly prohibits an adult driver from smoking a cigarette or using an e-cigarette while operating a motor vehicle when driving alone or with other adults. Virginia’s laws that regulate smoking and vaping—most notably the Virginia Clean Indoor Air Act—apply primarily to public and workplace indoor spaces, not to private vehicles.

However, this is where the nuance begins. The absence of a specific prohibition does not grant a driver immunity from legal consequences if their smoking or vaping leads to unsafe driving behaviors. The key legal frameworks that can come into play are distracted driving laws and, in more serious cases, careless or reckless driving statutes.

Prohibition: Smoking Tobacco with Minors Under 15

The most significant and explicit restriction regarding smoking in a vehicle in Virginia is designed to protect children. Under Code of Virginia § 46.2-810.1, it is unlawful for a person to smoke any lighted tobacco product in a motor vehicle, whether in motion or at rest, when a minor under the age of 15 is present.

Key details about this law include:

  • Definition of “Smoke”: The law specifically defines “smoke” as carrying or holding any lighted pipe, cigar, or cigarette of any kind, or inhaling/exhaling smoke from such products.
  • Penalty: A violation is a civil offense punishable by a $100 fine. No demerit points are assigned to your driver’s license, and no court costs are assessed for this specific violation.
  • Secondary Enforcement: This is a secondary offense, meaning a law enforcement officer cannot pull you over solely for this violation. However, if you are stopped for another primary traffic violation (such as speeding or a broken taillight), an officer can then issue an additional citation for smoking with a minor present.

This protection, which was expanded from an earlier age limit of under 8 to the current under 15, aims to shield children from the concentrated harms of secondhand smoke in enclosed vehicle spaces.

The Critical Distinction: Vaping with Minors is NOT Explicitly Illegal

In a unique and important legal distinction, Virginia’s vehicle smoking ban does NOT include vaping or e-cigarettes. The statute’s definition of “smoke” is tied to “lighted” tobacco products, which legally excludes electronic nicotine vapor products that produce an aerosol, not smoke from combustion. This means that, as of 2025, while it is illegal to smoke a traditional cigarette with a 14-year-old in the car, it is not a specific violation of § 46.2-810.1 to vape in the same situation. Despite this legal loophole, public health officials strongly advise against vaping in enclosed spaces with children due to the potential risks of secondhand aerosol exposure.

When Vaping or Smoking Can Lead to Other Legal Trouble

Distracted, Careless, or Reckless Driving

While there’s no specific law against smoking or vaping while driving (absent minors for smoking), Virginia’s general traffic safety laws could still apply if these activities impair your ability to operate your vehicle safely. If your vaping or smoking distracts you, you could be cited for:

  • Improper Driving / Careless Driving (§ 46.2-869): If your distraction is deemed to have slight culpability, a reckless driving charge might be reduced to improper driving, which is a traffic infraction with a fine of up to $500.
  • Reckless Driving: If your distraction causes you to drive in a manner that endangers life, limb, or property, you could face a more serious reckless driving charge, which is a Class 1 misdemeanor.
  • Injury to a Vulnerable Road User: If your careless driving due to a distraction like smoking or vaping causes injury to a pedestrian, cyclist, or other vulnerable road user, it can be elevated to a Class 1 misdemeanor under § 46.2-816.1.

Virginia’s hands-free cell phone law (§ 46.2-818.2) signals a strong stance against all forms of distracted driving, even if it doesn’t explicitly name tobacco or vape products.

2

The Absolute Prohibition: Vaping or Smoking Cannabis While Driving

Under Code of Virginia § 4.1-1107, it is unlawful for any person to use or consume marijuana or marijuana products while driving a motor vehicle on a public highway or while being a passenger in such a vehicle. A violation is a Class 4 misdemeanor. This is separate from and in addition to potential DUI charges if impairment is proven. Driving under the influence of any substance that impairs your ability to drive safely, including cannabis, is a serious criminal offense in Virginia.
