  • Manual Distraction: Taking one or both hands off the wheel to find a vape device, search for a lighter, light a cigarette, handle an ashtray, or adjust device settings.
  • Visual Distraction: Taking your eyes off the road to perform any of the above actions, or if your vision is temporarily obscured by a thick cloud of vapor or smoke.
  • Cognitive Distraction: Your mental focus is on the act of smoking or vaping rather than on the road and surrounding traffic.

If a law enforcement officer observes you driving erratically (e.g., swerving, failing to maintain a consistent speed) and determines that your smoking or vaping is the cause, you could be cited for distracted driving or a related moving violation. Maryland is a primary enforcement state for many distracted driving behaviors, meaning officers can pull you over for the distraction itself. Penalties can be significant, and under “Jake’s Law,” they are intensified if distracted driving results in serious injury or death.

A bill (HB 1392) was proposed in the 2025 legislative session to ban smoking, vaping, or consuming cannabis in any motor vehicle with a minor occupant, but this bill was withdrawn and did not become law. Therefore, while it is strongly discouraged for health reasons, it is not currently a specific traffic violation under state law.

However, it’s important to note that this does not preclude other potential legal issues. In extreme cases of endangerment, other child protection statutes could potentially be applied, though this would be highly situational.

Vaping or Smoking Cannabis While Driving

The legal landscape is starkly different when the substance being vaped or smoked is cannabis. Under Maryland Criminal Law § 10-125(b)(3), it is explicitly illegal for any occupant (driver or passenger) to smoke cannabis in a motor vehicle on a highway.
