Is It Illegal to Vape or Smoke While Driving in Wisconsin?

Vaping Guides, Laws and Regulations

In the Badger State, where scenic byways wind past dairy farms and major interstates like I-94 connect bustling cities, drivers often have questions about personal habits behind the wheel. A frequent query is: “Is it against the law to smoke a cigarette or vape while driving?” This guide provides a comprehensive breakdown of Wisconsin’s laws on vaping and smoking behind the wheel, incorporating state statutes, official resources, and recent legislative developments to offer a complete picture for drivers.

No Explicit Ban for Adults, But Distraction and Substance Laws Apply

As of 2025, there is no state statute that specifically makes this activity a traffic violation by itself when you are driving alone or with other adults in a privately owned vehicle. Wisconsin’s laws governing smoking and the use of electronic smoking devices, such as the Clean Indoor Air Act, primarily focus on public indoor spaces and places of employment. This act prohibits smoking and vaping in these enclosed areas but does not extend to private vehicles.

However, this is where the nuance begins. The absence of a specific prohibition does not grant a driver immunity from legal consequences if their smoking or vaping leads to unsafe driving behaviors. The key legal frameworks that can come into play are distracted driving laws and, in more serious cases, careless or reckless driving statutes.

When Smoking or Vaping Can Lead to Legal Trouble

1

Inattentive Driving Laws: A Broad Net

While smoking or vaping isn’t singled out, Wisconsin’s inattentive driving statute can still apply. This law states, “No person while driving a motor vehicle may be engaged or occupied with an activity, other than driving the vehicle, that interferes or tends to interfere with full attention.” This broad language allows a law enforcement officer to issue a citation if they determine that your smoking or vaping is causing a distraction and compromising safe operation.

Activities related to smoking or vaping that could constitute inattentive driving include:

  • Taking your hands off the wheel to find a vape device, search for a lighter, light a cigarette, or handle an ashtray.
  • Taking your eyes off the road to perform any of the above actions.
  • Having your vision temporarily obscured by a thick cloud of vapor or smoke.
  • Swerving, failing to maintain a consistent speed, or otherwise driving erratically while managing your smoking or vaping device.

A citation for inattentive driving can result in a fine of up to $200 and 4 demerit points on your driver’s license. If you hold a probationary or intermediate license, the consequences can be more severe, potentially extending the time until you can obtain an unrestricted license.

2

Reckless Driving: A More Serious Charge

If your distraction from smoking or vaping leads to more dangerous driving behavior or causes an accident, you could face more severe charges. Wisconsin law defines reckless driving as operating a vehicle in a manner that shows a willful or wanton disregard for the safety of others. A conviction for this misdemeanor can result in up to 6 months in jail and significant fines.

The Absolute Prohibition: Vaping or Smoking Cannabis While Driving

While some neighboring states have legalized recreational marijuana, it remains illegal in Wisconsin outside of a very limited low-THC CBD program. It is strictly illegal to smoke or vape marijuana while driving. This falls under the state’s laws against Operating While Intoxicated (OWI) of a controlled substance.

Wisconsin is a zero-tolerance state for THC, meaning if a blood test detects any amount of delta-9 THC in your system while you are driving, you can be charged with an OWI, even if you are not visibly “high” or impaired. A first-offense OWI for drugs can result in fines up to $1,000, jail time, and a license revocation of 6-9 months.
