While smoking is now banned, what is the law regarding vaping on the sand?

The official text of the new national decree provides a clear answer: it does not currently ban the use of e-cigarettes on beaches. The legislation specifically targets combustible tobacco, and the minister has not mentioned a general prohibition on vaping in these outdoor areas. This means that, at the national level, vaping on a public beach remains legally permissible.

However, this comes with a significant caveat: local municipalities have the authority to implement their own, stricter rules. A mayor can decide to prohibit vaping on all or part of their coastline. In such cases, clear signage stating “interdiction de fumer et de vapoter” (smoking and vaping prohibited) will be posted at the entrances to the affected zones. Therefore, before setting up your beach towel, it is crucial to check local signage or inquire at the local town hall (mairie) to avoid any unpleasant surprises and to know precisely what is allowed.

The French government’s broader strategy is focused on prevention, noting that 90% of smokers start before the age of 18. While the beach ban doesn’t currently include vapes, the Health Minister has indicated a desire to reduce the appeal of these devices to young people by limiting authorized nicotine levels and the number of available flavors in the future.

Where is Vaping Already Banned in France?

Beyond the beaches, France’s Public Health Code already has established restrictions on where vaping is prohibited. The use of e-cigarettes is strictly banned in:

  • All educational institutions and any premises that host, train, or accommodate minors.
  • Enclosed collective public transport (e.g., buses, trains).
  • Enclosed and covered collective workplaces.

These prohibitions aim to limit non-user exposure and reduce the appeal of e-cigarettes in shared, mandatory spaces. Professional spaces open to the public, such as shops or bars, are not covered by this national ban unless the owner or manager decides to prohibit vaping and clearly indicates this with specific signage.



What Are the Penalties for Violating Vaping Rules?

Vaping in a location where it is prohibited can be a costly mistake. The fine for such an infraction can reach up to €1,500. While the amounts actually applied are often lower, the potential penalty is a significant deterrent, especially for repeat offenses. This encourages most vapers to verify the local rules before using their e-cigarette.

In summary, while the July 1st decree marked a major change for smokers on French beaches, it does not directly impact vapers at the national level. However, the absence of a national ban does not mean absolute permission.
