FDA Adds 10 Chinese E-cigarette Companies to Import “Red List”

The U.S. Food and Drug Administration (FDA) has updated its import alert, known as the “Red List,” which empowers U.S. Customs and Border Protection to detain potential vaping products without physical examination. The updated list includes 13 additional e-cigarette manufacturers and distributors, with 10 of them being Chinese companies.

Under the Federal Food, Drug, and Cosmetic Act, new tobacco products must obtain the required marketing authorization to be compliant. Failure to do so will result in U.S. Customs and Border Protection having the authority to detain their goods.

The 13 companies and related products added to the “Red List” in 2024 are listed in the table provided by the FDA.
