On February 17, 2025, the Idaho House of Representatives introduced House Bill 244, a measure aimed at regulating electronic smoking devices in the state. Proposed by the Health and Welfare Committee, the bill seeks to identify and prohibit the sale of certain e-cigarette brands deemed illegal due to safety and compliance issues.

If passed, the bill would require the Idaho Department of Health and Welfare to publish a list of banned e-cigarette brands by July 1, 2025. This list would include brands associated with products identified in FDA warning letters, import alerts, seizure orders, or Department of Justice complaints. Exemptions would be allowed for products with withdrawn or stayed enforcement actions.

Proponents argue that the legislation is crucial for protecting consumers, especially minors, from potentially harmful products. However, some industry stakeholders oppose the bill, citing concerns about unfairly targeting certain brands and the potential economic impact on local businesses.

The bill’s passage could set a precedent for Idaho’s regulation of electronic smoking devices, but lawmakers must balance public health priorities with economic realities. The future of House Bill 244 remains uncertain as it progresses through the legislative process.
