Indonesia now imposes fines of up to IDR 750,000 (≈$50) and three months’ jail time for smoking or vaping while operating motorcycles or cars. The regulation, rooted in Traffic Law No. 22/2009, aims to reduce road accidents caused by impaired driver concentration.

Law Applies to All Motorists

Article 106 of the law prohibits drivers of all vehicles—from motorcycles to trucks—from engaging in activities that disrupt focus, including smoking. The Aceh Transportation Department reiterated the rule on February 10, 2025, stating:

“Violators face a maximum 3-month prison sentence or IDR 750,000 fine for endangering road safety.”

Enforcement applies equally to drivers of private cars, commercial trucks, and motorcycle riders. Authorities emphasize that even brief distractions—like lighting a cigarette or adjusting a vape—can lead to fatal collisions.

Vaping Included in Broad Crackdown

While the 2009 law initially targeted traditional cigarettes, recent updates explicitly include e-cigarettes. The move aligns with Indonesia’s stricter anti-nicotine policies, despite the country having one of Asia’s highest smoking rates.

Mixed Public Response

Critics argue the penalty disproportionately affects low-income riders, while road safety advocates praise the measure. “Distracted driving causes 23% of accidents in Indonesia,” said Transport Ministry spokesperson Hadi Mulyadi. “This law prioritizes collective safety over individual habits.
