Indonesia Jakarta to Ban Vaping and Smoking in Public with Heavy Fines
The Provincial Government of DKI Jakarta, in collaboration with the regional legislature (DPRD), is finalizing a comprehensive Draft Regional Regulation (Raperda) on Smoke-Free Areas (Kawasan Tanpa Rokok – KTR). This new legislation aims to significantly strengthen public health protections by strictly regulating locations where smoking is prohibited and introducing substantial administrative sanctions for violations. Crucially, the DPRD, with support from the Governor, is pushing for these regulations to treat vaping (e-cigarette use) on par with conventional smoking, subjecting it to the same restrictions and penalties.
Expanded Smoke-Free Zones (KTR) in Jakarta
The draft Raperda KTR outlines two main categories for smoke-free zones, both of which will now apply to vaping as well as traditional smoking:
1. Areas with a Total Ban on Smoking and Vaping:
A complete prohibition will be enforced from the outermost boundary or fence of these locations:
- Healthcare facilities (hospitals, clinics)
- Places of teaching and learning (schools, campuses, educational institutions)
- Children’s playgrounds
- Places of worship
- Public transportation (buses, trains, etc.)
- Sports infrastructure and venues
2. Areas Required to Provide Designated Smoking/Vaping Areas:
These locations must provide specific, clearly marked outdoor smoking/vaping areas that are separate from the main building, away from entrances/exits, and not in pedestrian pathways. The smoke-free boundary for the main premises is defined from the outermost dripline of the roof.
- Workplaces
- General public places (e.g., markets, shopping centers)
- Integrated public spaces
- Venues requiring crowd permits
- Nightlife entertainment venues (proposed addition)
Strict Sanctions and Fines for Violations
The Raperda KTR introduces a robust system of administrative sanctions for non-compliance, with fines varying significantly based on the offense:
- Smoking or Vaping in a KTR: An individual caught violating the ban faces a fine of IDR 250,000 or may be required to perform on-the-spot social work.
- Advertising or Sponsoring Tobacco/Vape Products (City-Wide): Any entity advertising, promoting, or sponsoring tobacco or vape products anywhere within Jakarta could face a massive fine of IDR 50 million.
- Advertising, Selling, or Buying in a KTR: Specifically advertising, promoting, sponsoring, selling, or even purchasing tobacco/vape products within a designated KTR will incur a fine of IDR 1 million.
- Sales Near Schools/Playgrounds: Selling tobacco/vape products within a 200-meter radius of schools and children’s playgrounds will result in a fine of IDR 1 million.
- Displaying Tobacco/Vape Products at Point of Sale (in KTR): Retailers displaying tobacco or vape products at points of sale within KTRs (where sales might be restricted or banned) face a fine of IDR 10 million.
Enforcement of these new regulations will be primarily carried out by the Satuan Polisi Pamong Praja (Satpol PP), Jakarta’s Public Order Agency, with support from other relevant technical regional work units (SKPD).

Smoking and Vaping Still Permitted in Designated Zones
Officials have clarified that the Raperda KTR does not represent an outright ban on all smoking or vaping activities throughout Jakarta. The Head of the DKI Jakarta Health Service, Ani Ruspitawati, confirmed that individuals are still permitted to smoke or vape outside the designated KTRs, provided they adhere to the established boundaries and regulations. “Smoking is still allowed, but it must be done outside the Smoke-Free Areas,” she stated. The provincial government also plans to intensify public education campaigns regarding these new rules, collaborating with community leaders, civil society organizations, local media, and digital influencers. This legislative effort is part of Jakarta’s long-term strategy to control tobacco and nicotine consumption without completely stifling the tobacco industry, which remains a national export commodity. Jakarta is currently one of 45 regencies/cities in Indonesia yet to have a comprehensive Regional Regulation on Smoke-Free Areas.
