Lithuania Implements New Tobacco and Related Product Sales Regulations Starting January 1, 2025

Effective January 1, 2025, amendments to the Law on Tobacco, Tobacco Products, and Related Products Control (hereafter referred to as the Law) will introduce significant changes to the retail sale of tobacco, tobacco products, and related products in Lithuania. The key changes are as follows:

  1. Article 151 of the Law prohibits the public display of tobacco products, related products, and devices intended for their consumption at retail outlets. However, this prohibition does not apply to products sold in dedicated tobacco product stores or sections, provided that these products and devices are not displayed in external windows or through other external equipment of these stores or sections.
  2. Article 17, Paragraph 1 of the Law reaffirms the prohibition of tobacco product advertising in Lithuania. However, certain information about tobacco products, which is not considered advertising, can still be provided at retail outlets. This information is limited to the names of the manufacturer, the tobacco products being sold, related products, devices intended for their consumption, the words “We trade” or “We sell,” and the prices per unit package or outer packaging.
  3. Article 17, Paragraph 6 of the Law stipulates that the above-mentioned information can only be provided at the points of sale where tobacco products, related products, and devices intended for their consumption are sold. This information cannot be provided in leaflets, flyers, or other advertising media intended for consumers to take away. Additionally, retail outlets are prohibited from displaying imitations or images of tobacco products, related products, their unit packages, or devices intended for their consumption.

Furthermore, the Department draws attention to the Order of the Minister of Economy and Innovation of the Republic of Lithuania No. 4-495, which comes into force on January 1, 2025. This order comprehensively regulates the procedure for providing information about tobacco products, related products, and devices intended for their consumption at retail outlets.

These new regulations aim to reduce public exposure to tobacco products and related devices, while still allowing for the sale of these products in a controlled manner. Businesses engaged in the retail sale of tobacco and related products should familiarize themselves with these changes to ensure compliance with the new requirements.
