Massachusetts, known for its strict tobacco regulations, is set to make history once again as three state lawmakers plan to introduce a generational tobacco ban bill next year. Sen. Jason Lewis, D-Winchester, along with Rep. Tommy Vitolo, D-Brookline, and Rep. Kate Lipper-Garabedian, D-Malden, aim to prohibit anyone born after a specific date from ever purchasing tobacco products in the state.

A Pioneering Effort in Tobacco Control

If passed, Massachusetts would become the first state in the U.S. to implement such a ban. The proposed legislation would not take away the right to purchase tobacco products from anyone currently of legal age but would instead set a cut-off date, likely no earlier than 2004 or 2005, given the bill’s introduction next year.

This move comes after the state raised the minimum age to purchase tobacco products to 21 in 2018, making it the sixth state to do so. Massachusetts has consistently ranked among the least tobacco-friendly states in the U.S., with one of the highest state tax rates on cigars and being one of only two states to successfully ban some flavored tobacco products.

Building on Local Success

The lawmakers’ decision to push for a generational tobacco ban gained momentum following the Massachusetts Supreme Judicial Court’s decision to uphold a similar local law in Brookline, Mass. earlier this year. The Brookline law banned anyone born after Jan. 1, 2000, from ever purchasing tobacco products and e-cigarettes. This success has sparked interest from other lawmakers in the state, despite some pushback in nearby Peabody, Mass., where a similar proposal was recently tabled.

A Global Trend

Massachusetts is not alone in considering a generational tobacco ban. The U.K.’s Parliament is set to have another reading of the Tobacco and Vapes Bill this week, which could ban anyone born after Jan. 1, 2009, from ever purchasing tobacco and vaping products. While Massachusetts won’t be the first state to introduce such legislation, it could be the first to see it pass, given its history of strong tobacco control measures.

As the fight against tobacco use continues, the proposed generational tobacco ban in Massachusetts represents a bold step towards creating a smoke-free future. The bill’s progress will be closely watched by public health advocates and policymakers alike, as it could set a precedent for other states to follow.
