The President Andrés Manuel López Obrador signed a decree on May 31, 2022World No Tobacco Day – prohibiting the circulation and marketing of all electronic cigarettes in Mexico. This action aimed to strengthen existing restrictions, including an October 2021 ban on import and export, which authorities claimed were being bypassed via e-commerce.

During the announcement, President López Obrador displayed a device, emphasizing the unknown harm to youth. Deputy Health Secretary Hugo López Gatell supported the ban, calling claims that vaping is safer than smoking or a valid cessation tool a “big lie” and stating that “vapors are also harmful to health.”

The decree followed a maximum health alert issued by Mexico’s health risk commission (COFEPRIS) regarding toxins in vaping products, specifically citing lung damage risks associated with vitamin E acetate found in some cartridges.

This 2022 decree sought to overcome previous legal challenges; Mexico’s Supreme Court had declared parts of an earlier tobacco law prohibiting e-cigarettes unconstitutional in late 2021, citing freedom of commerce, but stopped short of ordering the products’ regularization. President López Obrador’s administration consistently pushed for tighter controls throughout his term, culminating in this comprehensive sales and circulation ban.
