Mexico’s Durango State Moves to Harmonize Vaping Device Ban with Federal Law

On 03/18/2025, a reform initiative was introduced in the state of Durango, Mexico, to align local legislation with the federal ban on the sale of electronic cigarettes and vaping devices. The proposal aims to prohibit and penalize the commercialization, distribution, and use of these products within the state.

Local representative Sandra Amaya highlighted the risks associated with e-cigarettes and vaping devices, which have been marketed as a safe alternative to traditional tobacco products. However, she emphasized that these devices can lead to addiction and cause serious health problems. Amaya recalled that health authorities have been warning about these dangers since 2021, and in 2022, the Federal Government of Mexico banned the sale of these products nationwide.

The proposed reform seeks to harmonize Durango’s Constitution with the federal ban and introduce penalties in the state’s Penal Code for those who distribute or facilitate access to these substances to minors. Under the proposed amendments, anyone who procures, fosters, enables, promotes, induces, or facilitates access to electronic cigarettes, vaping devices, narcotics, chemical precursors, fentanyl, or other synthetic drugs to a minor or someone who cannot understand the significance of the act would face imprisonment for two to eight years and fines ranging from 144 to 576 times the Unit of Measure and Update (UMA).

Amaya stressed the importance of taking firm action to protect children and ensure a future of opportunities, health, and development for Durango. She concluded, “It is not enough to prohibit; we must act firmly to protect our children and guarantee a Durango of opportunities, health, and development.”
