Nepal Lifts E-Cigarette Ban

The Patan High Court in Nepal has ordered the government to lift its restrictions on the import and sale of electronic cigarettes (vapes), paving the way for vape businesses to resume operations. A Division Bench of Justices Kabi Prasad Neupane and Hemant Rawal issued the verdict in response to a writ petition filed by Vape Mandu Traders against several government bodies, including the Ministries of Finance and Health, and the Customs Department.

The government had attempted to enforce a ban on vape trading by issuing circulars to customs offices, citing a 2015 Tobacco Products Control and Regulation Directive. This led to customs offices halting the clearance of imported vape products. However, the court ruled that this directive was not legally sufficient to justify blocking trade.

The use of vapes has been on the rise in Nepal, and the sector has a notable economic footprint. In the last fiscal year (2023/24), the government collected over Rs 230 million (approximately $1.7 million USD) in customs revenue from vape imports alone. The High Court’s decision effectively nullifies the government’s recent enforcement push and allows for the legal import and sale of e-cigarettes to continue.
