North Carolina’s New Vaping Law HB 900 Took Effect Recently
North Carolina’s House Bill 900, now in effect, prohibits certain vape products, targeting youth access, while vape shops face a June deadline and express concerns over business impact.
North Carolina’s House Bill 900, which took effect recently, aims to curb underage vaping by banning certain vape products and increasing regulatory oversight. The law, passed unanimously in 2024, gives vape shops until the end of June to sell or dispose of the prohibited items, which primarily include flavored vapes and vape juices not regulated by the FDA.
The new legislation is intended to prevent children and teenagers from accessing these products, with a strong emphasis on regulation. According to the state Revenue Department’s Vapor Certification Registry, many of the banned items are those whose contents are unknown due to a lack of FDA oversight. From May 1st, stores were given a 60-day grace period to clear the affected products from their shelves.
However, local vape shop managers like Cheyenne Dietrich of 20-20 Tobacco and Vape have expressed concerns about the financial impact on small businesses. “A lot of smoke shops, like tobacco shops, their main sales are from vapes, so when you take that away it’s going to cause a big hit to small businesses, which is going to affect people’s jobs and their livelihoods,” Dietrich stated. She also voiced worries about her own job security, as store profitability directly impacts her employment.
House Bill 900 also mandates unannounced compliance checks on stores to ensure the banned products are no longer being sold. Vape products from major tobacco companies like Njoy, Vuse, and Juul, which are typically menthol or tobacco-flavored and FDA-regulated, will remain legal. Despite the new restrictions, nearly 400 vape products will still be available for sale in North Carolina after the grace period concludes.
