Peru’s Congress Enacts Law 32159 to Control Cigarette Consumption and Vape Use

The Peruvian Congress has enacted Law No. 32159, which establishes measures to control the consumption of tobacco products, nicotine, and their substitutes to protect life and health. This legislation modifies previous regulations related to the topic and marks the first time that electronic cigarettes have been regulated in the country.

The law aims to protect people’s health from the consequences of consuming tobacco products, nicotine, or their substitutes, as well as exposure to tobacco smoke and other emissions from electronic cigarettes with or without nicotine dispensation and heated tobacco products, according to RPP.

Promotion and Sponsorship Restrictions

The new law prohibits smoking or vaping in health centers, educational institutions, state entities, workplaces, enclosed public spaces, and any means of transportation, which are now considered 100% smoke-free environments.

The legislation also bans all forms of advertising, promotion, and sponsorship of tobacco products or their substitutes, including those with cross-border reach. The law clearly states that all direct and indirect advertising and promotion of these products are prohibited.

Ensuring Compliance

The Ministry of Health, local governments, Indecopi, and various civil society associations will ensure compliance with the provisions of the new law within their respective jurisdictions.

The enactment of Law 32159 marks a significant step in Peru’s efforts to control tobacco and nicotine consumption, protect public health, and regulate the growing use of electronic cigarettes and vaping devices. The legislation’s comprehensive approach, encompassing advertising restrictions and designating smoke-free areas, demonstrates the government’s commitment to creating a healthier environment for its citizens.
