Philippines DTI Orders Takedown of Illegal Vapes Online
The Department of Trade and Industry (DTI) in the Philippines has ordered all e-commerce and other digital platforms to immediately remove postings of illegal and uncertified vape products. The DTI identified that certain online merchants were selling vaporized nicotine and non-nicotine products that lack the required fiscal markings, tax stamps, and Philippine Standard License marks.
This action is a violation of several laws, including Republic Act (RA) 11900 (the Vaporized Nicotine and Non-Nicotine Products Regulation Act), the Standards Law, and other administrative orders. Digital platforms have been given seven days to remove all web pages, listings, or applications of identified merchants offering these illegal products.
The DTI reminded retailers and platforms of their obligations under RA 11900 and the Internet Transactions Act of 2023, which require sellers of regulated goods to provide necessary permits and licenses. Platforms failing to comply face substantial fines under various laws, ranging from P20,000 to P1,000,000, and potential suspension of their operations in the Philippines. Consumers are encouraged to report violations to the DTI’s dedicated office for vaporized products.
