Up to 12 Years in Prison for Vaping in Quintana Roo, Mexico
In Quintana Roo, Mexico, the Labor Party (PT) congressman, Hugo Alday, has presented a package of initiatives to the state’s Congress to reform the Political Constitution and the local Penal Code. The objective is to strictly regulate the consumption of vaping devices or electronic cigarettes and toughen sanctions against those who promote the consumption of synthetic drugs among minors.
The proposal suggests modifying Article 13 of the State’s Political Constitution and Article 191 of the Penal Code to address the consumption of toxic substances. Alday explained that the initiative responds to an alarming increase in serious pulmonary diseases associated with the use of electronic cigarettes and the rise in synthetic drug consumption affecting young people.
The reform to Article 13 of the local Constitution seeks to establish a constitutional principle that prohibits and sanctions the use of chemical substances, precursors, and synthetic drugs without legal authorization. This will facilitate greater surveillance in the commercialization and distribution of these products, especially in tourist zones and areas with high youth traffic.
The proposal also modifies Article 191 of the Quintana Roo Penal Code to more severely sanction those who facilitate, induce, supply, or encourage the consumption of electronic cigarettes, vaping devices, or any other form of tobacco use among minors and individuals without the capacity to comprehend the significance of these acts. The sanction for this crime can range from six to 12 years in prison, aiming to generate a deterrent effect and prevent the proliferation of these devices among the most vulnerable populations.
As part of the modifications, the strengthening of prevention campaigns in society is proposed, especially among young people, to reduce the attractiveness and accessibility of these harmful products. Alday emphasizes that the proposal is not just a punitive measure but a comprehensive strategy to protect the health of future generations and create a safer state with less violence and diseases associated with addictions.
