Sponsored by State Representative Brian Mulder and Senator Sydney Davis, the legislation aims to ensure that vaping products sold in the state meet FDA standards and are free from harmful, untested ingredients.
Key Provisions of HB 1069
HB 1069 proposes several measures to regulate the sale of vaping products in South Dakota:
- State Registration: Vape shops and retailers must register with the state to sell vaping products.
- FDA Compliance: All products must meet FDA guidelines, ensuring they are safe for consumer use.
- Licensing Requirements: Similar to existing regulations for alcohol, tobacco, and fireworks, sellers of vaping products will need a state license.
Senator Davis highlighted the importance of these measures: “We already require licenses for selling alcohol, tobacco, and fireworks. It’s not unreasonable to ask vape sellers to follow the same rules, especially when these products can harm our kids.”
While public health advocates support the bill, some vape shop owners worry about the potential burden of additional regulations. However, proponents argue that the benefits of ensuring product safety far outweigh the costs of compliance.
One local vape shop owner, who wished to remain anonymous, stated: “We already follow strict guidelines to ensure our products are safe. This bill will level the playing field and shut down the illegal market.”
