Tennessee’s New Vape Directory Law Begins August 1st
New regulations for vape products are taking effect in Tennessee, introducing significant changes to how these items are taxed, sold, and regulated. As of this Friday, retailers in the state can only purchase vapor products from distributors or wholesalers who are licensed to sell tobacco products.
A key component of the new law (HB0968/SB0763) is the creation of a state-managed product directory. By August 1, 2025, all manufacturers of vapor products sold in Tennessee must register each product with the Department of Revenue for inclusion in this directory. The department will then publish the official directory on its website on January 1, 2026.
Following the directory’s publication, retailers and distributors will have a 60-day grace period to remove any unlisted vapor products from their inventory. After this period, any unlisted products intended for sale will be subject to seizure, forfeiture, and destruction. This measure aims to ensure that only compliant and registered products, which are expected to align with FDA authorization status, are available in the state. Additionally, as of July 1st, vapor products in Tennessee are now subject to a new tobacco tax at a rate of 10% of the wholesale cost price.
