US ITC Extends Disposable Vape “337” Investigation to September 2025
The United States International Trade Commission (USITC) announced on August 29 that it will not review the Chief Administrative Law Judge’s (CALJ) preliminary ruling issued on July 31, 2024. This decision effectively extends the target date for completing the investigation into disposable e-cigarette devices, their components, and packaging to September 29, 2025.
CALJ’s Preliminary Ruling Remains Unchallenged
The CALJ’s preliminary ruling, made under Section 337 of the Tariff Act of 1930 (19 U.S.C. 1337) and the Commission’s rules (19 CFR Part 210), aims to avoid conflicts with the schedules of other ongoing investigations. As a result, the investigation’s findings will not be finalized before May 29, 2025. The USITC’s decision not to review this ruling solidifies the new target completion date.
Complaint Alleges False Advertising and Unfair Competition
R.J. Reynolds Tobacco Company and R.J. Reynolds Vapor Company filed the original complaint on December 15, 2023, alleging that certain disposable e-cigarette devices, their components, and packaging violate Section 337 of the Tariff Act of 1930. The complaint cites false advertising, false designation of origin, and unfair competition as the primary reasons, claiming that these practices significantly harm the U.S. domestic industry.
Investigation Involves Multiple Companies
The investigation encompasses up to 25 companies, including those based in the United States, Shenzhen, and other regions with ties to the tobacco and e-cigarette industries. On June 13, 2024, the Commission approved the addition of four more companies as respondents, further expanding the scope of the investigation.

The Commission will announce its final decision by September 29, 2025.
