Western Australia Bans Vaping in All Enclosed Workplaces
New Regulations Align E-cigarette Rules with Existing Smoking Bans to Protect Workers
Vaping and the use of e-cigarettes, including heated tobacco products, are now officially banned in all enclosed workplaces across Western Australia (WA). The state government has extended existing Work Health and Safety Regulations, which already covered tobacco smoking, to explicitly include these newer nicotine delivery systems.
This significant regulatory change applies to both the Work Health and Safety (General) Regulations 2022 and the Work Health and Safety (Mines) Regulations 2022. While previous regulations mandated employers to prevent worker exposure to potentially hazardous chemicals “so far as reasonably practicable,” the updated rules now provide explicit protection from the risks specifically associated with e-cigarette aerosol and secondhand vapor exposure.
The definition of e-cigarettes under the amended regulations has also been broadened to ensure it encompasses “heated tobacco” products, a category that has gained market presence more recently.
Government Cites Health Risks and Worker Safety
Industrial Relations Minister Simone McGurk emphasized the government’s commitment to worker safety and health as the primary driver for this change. “There is robust evidence to show vapes are full of dangerous substances and may include chemicals that can cause life-threatening illnesses and cancer,” Minister McGurk stated. “This change to our workplace regulations reflects this growing evidence of health risks associated with the use of e-cigarettes and second-hand vapour exposure.”
She added, “The Cook Government takes the safety and health of WA workers very seriously, and this addition to the laws is a further example of our commitment to their protection.”
Guidance for Employers and Workplaces
With the new ban in effect, employers in Western Australia are expected to manage vaping in the workplace using a similar approach to how they currently manage traditional tobacco smoking. This includes several key steps:
- Consultation with Workers: Employers should consult with their employees about workplace health and safety issues, including the implementation and enforcement of the new vaping ban.
- Workplace Policy Development: Businesses are encouraged to develop or update their workplace policies to clearly reflect the ban on vaping in all enclosed areas.
- Designated Outdoor Areas: Vaping, like smoking, should only be permitted in designated outdoor areas, away from building entrances and non-enclosed workspaces where vapor could drift.
- Risk Factor Consideration: Workplaces should consider any specific risk factors relevant to their environment, such as the presence of children or vulnerable individuals, when establishing their policies and designated areas.
By aligning the rules for vaping with those for smoking, the Western Australian government aims to create a consistent and comprehensive approach to protecting workers from airborne contaminants and promoting healthier workplace environments statewide.
