Finland Proposes Smoking Ban in Cars with Children Under 15
The Finnish government has put forward a supplementary proposal to its Tobacco Act, which was initially submitted to Parliament in February. The new proposal seeks to ban smoking in cars when children under the age of 15 are present. The primary objective of this smoking ban is to minimize children’s exposure to tobacco smoke and the associated harmful health effects.
The proposed ban would not apply to living quarters in vehicles, such as camper vans, and would be monitored by municipalities. Municipal child welfare authorities could inform municipalities about cases of smoking in cars with children.
Aligning with the Tobacco Act’s Goal of Promoting Smoke-Free Lifestyles
The supplementary government proposal aligns with the overall aim of the Tobacco Act, which is to promote smoke-free lifestyles among young people. However, it is important to note that smoking in cars would not be punishable under the proposed legislation.
This is not the first time that a smoking ban in cars has been proposed for inclusion in the Tobacco Act. In 2009, a similar proposal was put forward, but the parliamentary Constitutional Law Committee deemed it to be against the provisions of the Finnish Constitution regarding personal liberty, privacy, and the sanctity of the home. Since then, several parties have proposed banning smoking in cars with children.
The Tobacco Act Reform and EU Tobacco Products Directive
The new Tobacco Act is set to come into force on May 20, 2016, in line with the EU Tobacco Products Directive, which Finland and other EU countries will enforce by that date. Some of the proposed changes to the Act are based on Finland’s own considerations and legislative needs.
The current Tobacco Act, which dates back to 1976, has been amended dozens of times since its introduction. The reform of the Tobacco Act aims to discourage people from starting to use tobacco products and becoming nicotine dependent, while also supporting those who wish to quit. Another key objective is to protect non-smokers from exposure to tobacco smoke.
As Finland moves forward with this supplementary proposal to ban smoking in cars with children, it demonstrates the country’s commitment to prioritizing the health and well-being of its youngest citizens. By taking steps to reduce children’s exposure to tobacco smoke, Finland is setting an example for other nations to follow in the fight against the harmful effects of smoking.
