Florida Empowers Local Governments to Ban Smoking at Public Beaches and Parks
Governor Ron DeSantis has signed a bill giving local governments in Florida the authority to restrict smoking on public beaches and parks. The legislation, House Bill 105, was passed by the Florida Legislature in March and aims to protect the public from the health hazards of secondhand tobacco smoke.
Under the new law, local leaders have full jurisdiction in regulating smoking at beaches, including the creation of designated smoking zones, the imposition of fines, stricter laws on the disposal of cigarette butts, and even outright bans. However, the law makes an exception for the smoking of unfiltered cigars.
The bill, known as the “Florida Clean Air Act,” defines smoking as “inhaling, exhaling, burning, carrying, or possessing any lighted tobacco product, including cigarettes, cigars, pipe tobacco, and any other lighted tobacco product.”
Ocean Conservancy Advocates for the Bill
The Ocean Conservancy, the nation’s oldest conservation nonprofit, was a strong advocate for the passage of this legislation. Jon Paul Brooker, director of Florida Conservation at Ocean Conservancy, hailed the bill’s signing as “a major victory for the health of our beaches and seas throughout the Sunshine State.”
Brooker emphasized the environmental impact of cigarette butts, stating, “Cigarette butts may be small, but they have a lasting, harmful effect on our environment.” According to Ocean Conservancy, cigarette butts contribute to the microplastics problem that impacts wildlife, as the plastic fibers in the butts erode into smaller bits and accumulate in fish and other wildlife.
Local Governments Given Flexibility in Implementation
The new law gives local governments the flexibility to tailor their smoking regulations to suit the needs of their communities. They can choose to create designated smoking areas, enforce stricter disposal laws, or implement complete bans on smoking at public beaches and parks.
This approach allows local leaders to consider factors such as the preferences of their constituents, the environmental impact of smoking on their specific beaches and parks, and the resources available for enforcement.
