Columbus, Cincinnati, and Others Challenge State Measure Prohibiting Local Regulation of Tobacco Sales

On Tuesday (14/May), Columbus, Cincinnati, and more than a dozen other Ohio cities filed a complaint in Franklin County Common Pleas Court, challenging the state legislature’s measure that prohibits them from imposing regulations on tobacco. The cities argue that the measure violates home rule and would harm Ohioans’ health.

The Czech Ministry of Health has drafted a decree aimed at banning flavored e-cigarettes, also known as vaporizers, in an effort to reduce their appeal to non-smokers, especially children. TV Nova obtained the decree, which is expected to take effect next year and will restrict the taste and appearance of e-cigarettes to mimic traditional cigarettes.

In a recent development, several Kentucky businesses that sell vapes, along with the Kentucky Hemp Association and Kentucky Vaping Retailers Association, have filed a lawsuit against the state government over the newly passed House Bill 11 (HB 11). The law, which is set to take effect in 2025, aims to restrict the sale of vape products to only those authorized by the U.S. Food and Drug Administration (FDA) or those currently in the approval process. New York, NY – In a major crackdown on the illegal sale of flavored disposable vapes, New York City Mayor Eric Adams and Corporation Counsel Sylvia O. Hinds-Radix announced today that the city has filed a lawsuit against 11 wholesalers. The defendants, located in Brooklyn, Queens, Long Island, and upstate New York, are accused of distributing youth-friendly flavored disposable vapes to retail vape and smoke shops, convenience stores, and directly to consumers over the internet, in violation of federal, state, and city laws. Concerned over growing youth addiction, Lithuania recently passed legislation prohibiting the import of vape liquids containing added sweeteners or sugar starting November 2024.

On December 15th, 2023, the Lithuanian parliament (Seimas) overwhelmingly voted to amend existing tobacco control laws, banning future imports of sweetened nicotine e-liquids for electronic cigarettes.

The Bulgarian government has proposed a ban on the sale of e-cigarettes with characteristic taste-aromatic qualities and flavorings in any of their constituent parts, such as filters, paper, packaging, capsules, or other technical elements. The Council of Ministers submitted the bill for amendments to the Law on Tobacco and Tobacco-Related Products to the Parliament’s Registry on October 2nd.

Arizona Attorney General Kris Mayes has joined a coalition of attorneys general from across the country in calling for a ban on flavored vape products that target younger demographics.
