New Resources Provide Detailed Instructions on Compliance, Product Legitimacy, Age Verification, and Recycling Requirements
The Association of Convenience Stores (ACS) has published a comprehensive guide and accompanying poster to assist retailers in preparing for the upcoming ban on disposable vaping products in the UK. The ban, set to take effect on June 1, 2025, will make it illegal for retailers to sell, offer for sale, or possess for sale any disposable vaping devices.
Key Areas Covered in the “Selling Vapes Responsibly” Guide
Developed in collaboration with Buckinghamshire and Surrey Trading Standards, the ACS guide provides detailed information on several critical aspects of vape sales and compliance, including:
- Preparing for the Disposable Vape Ban:
Retailers are advised to sell through all existing disposable vaping products before June 1, 2025, to avoid commercial losses and enforcement action. After the ban takes effect, any remaining disposable vapes must be stored away from the sales floor, clearly separated from other goods, and marked as not for sale. The guide offers tips for identifying compliant vaping products, such as checking for realistic puff counts (around 600 or fewer), verifying that health warnings cover at least 30% of the front and back of the packaging, and confirming that the warning text matches the specific phrase required in the UK. Retailers can also use the MHRA’s online tool to search for approved e-cigarette products by brand, type, or name. - Age Verification and Preventing Proxy Sales:
As e-cigarettes are age-restricted products with a legal purchase age of 18, the guide recommends implementing Challenge 25 policies to prevent underage sales. This involves training staff to request valid proof of age from any customer who appears under 25 and clearly communicating the policy to customers through visible in-store signage. The guide also advises adopting a consistent approach to identifying and preventing proxy sales, where adults purchase nicotine products on behalf of underage individuals.
