The UK government has unveiled strict penalties for retailers who violate the upcoming disposable vape ban, set to take effect on 1 June 2025. Businesses caught selling single-use vapes after this date could face fines of up to £5,000, imprisonment for up to two years, or both. The Department for Environment, Food and Rural Affairs (Defra) has outlined enforcement measures, which vary across England, Wales, Scotland, and Northern Ireland.

Enforcement and Penalties Across the UK

England

  • Enforcement Body: Local Trading Standards authorities.
  • Penalties:
    • Initial violations may result in civil sanctions, including stop notices, compliance notices, or a £200 fine.
    • Repeated offences could lead to unlimited fines, a two-year prison sentence, or both. Retailers may also face cost recovery notices, requiring them to cover investigation expenses.

Wales

  • Enforcement Body: Local authorities.
  • Penalties:
    • Fixed fines of £200 or variable fines exceeding £200.
    • Additional measures include enforcement cost recovery notices, non-compliance penalties, and stop notices.

Scotland

  • Enforcement Body: Local authorities, with criminal cases prosecuted by the Crown Office and Procurator Fiscal Service (COPFS).
  • Penalties:
    • Summary conviction fines of up to £5,000.
    • Further convictions may result in a two-year prison sentence, a fine, or both.
    • Failure to comply with enforcement requirements could lead to a £5,000 fine.

Northern Ireland

  • Enforcement Body: Local authorities, with no civil sanctions available.
  • Penalties:
    • Summary conviction fines of up to £5,000 in a Magistrates’ Court.
    • Crown Court convictions may result in a two-year prison sentence, a fine, or both.
    • Failure to provide requested information could lead to a £5,000 fine.

What Retailers Must Do with Remaining Stock

From 1 June 2025, retailers must ensure they no longer sell or supply single-use vapes. Failure to comply risks commercial losses and legal action. Retailers with leftover stock must:

  1. Separate unsellable vapes from other products.
  2. Label them as unsellable.
  3. Remove them from shop floors or online stores until collected by a registered vape recycling service.

Will Vapers Face Penalties?

The ban targets businesses, not individual consumers. Vapers will not face penalties for possessing disposable vapes after the ban. Enforcement focuses on retailers and distributors, ensuring they comply with the prohibition and dispose of stock responsibly.
